Terms and Conditions for Short-Term Rentals Version 1. 01-01-2025

(“The Property”)
1. Introduction
These Terms and Conditions (“Terms”) apply to all bookings made through Max Beach Golf for short-term stays in our apartments located in Playa Flamenca, Costa Blanca, Spain. By making a reservation, the guest agrees to be bound by these Terms.
Max Beach Golf is a trading name under the legal entity Michal Janusz Wykowski, operating as an autonomo in Spain.
2. Booking Process
• Reservation: Bookings can be made via our official website or through third-party platforms such as Booking.com.
• Confirmation: A booking is considered confirmed when the guest receives a confirmation by email, whatsaap, messanger or other form of communication from Max Beach Golf.
• Payment: Payment can be made via the platform (e.g., Booking.com) or directly to Max Beach Golf by bank transfer or by cash on arrival.
• Deposit: A deposit may be required at the time of booking. The remaining balance is due 7 before arrival.
3. Check-in & Check-out
• Check-in Time: Check-in is from 3:00 PM on the day of arrival.
• Check-out Time: Check-out is by 11:00 AM on the day of departure.
• Late check-out or early check-in requests are subject to availability and may incur additional fees.
4. Rates & Taxes
• Rental Price: The rental price includes all applicable taxes, utilities, and fees unless otherwise specified.
• Additional Charges: Any extra charges incurred during the stay (e.g., cleaning fee, additional services) will be added to the final invoice.
• Currency: All payments must be made in Euros (€).
5. Cancellations & Refunds
• Cancellation Policy:
• Standard bookings can be canceled free of charge up to 7 days before the check-in date. Cancellations within this period will incur a 50% charge of the total booking price.
• Non-refundable bookings will not be eligible for a refund under any circumstances.
• No-show Policy: In the event of a no-show, the full rental price will be charged.
6. Security Deposit
A security deposit of €200 may be required upon check-in. This deposit will be refunded upon check-out, subject to no damage or outstanding charges.
7. Guest Responsibilities
• Occupancy Limits: The apartment is for residential use only. The maximum number of guests per apartment is limited to 4 people.
• Conduct: Guests must respect the rights and privacy of other guests and neighbors. No loud noise or disruptive behavior will be tolerated.
• Damage or Loss: Guests are responsible for any damage to the apartment or its contents during their stay. A charge will be made for repairs or replacements if necessary.
• Smoking: Smoking is prohibited inside the apartments. A cleaning fee will apply if smoking occurs inside the property.
• Pets: Pets are not allowed unless prior written approval is obtained. An additional fee may apply for approved pets.
8. House Rules
Guests must comply with all house rules outlined upon check-in. Failure to do so may result in immediate eviction from the property without refund.
9. Maintenance & Repairs
• Property Condition: The property is cleaned and maintained regularly. In case of any issues, guests should notify us immediately to allow prompt resolution.
• Repair Emergencies: Any urgent repair needs (e.g., plumbing, electrical issues) will be addressed promptly, but no refunds will be given for any inconvenience caused.
10. Liability & Insurance
• Liability: Max Beach Golf is not responsible for any injury, loss, or damage to personal belongings during the guest’s stay at the property.
• Travel Insurance: We strongly recommend that all guests purchase travel insurance to cover any potential cancellations, medical expenses, or lost property.
11. Privacy & Data Protection
Max Beach Golf will collect and process guests’ personal data in compliance with applicable data protection laws. Information may be shared with third-party platforms like Check-in Scan or Booking.com for booking and payment processing.
12. Compliance with Legal Requirements
Max Beach Golf complies with all applicable legal requirements in Spain, including those specific to the Valencian Community and the Alicante region.
All apartments offered for short-term rentals by Max Beach Golf are registered and hold the necessary tourist licenses in accordance with Spanish law. These licenses ensure that the properties meet all regulatory standards and can legally be rented to guests.
13. Force Majeure
In the event of unforeseen circumstances beyond our control (e.g., natural disasters, pandemics), we reserve the right to cancel or reschedule bookings without liability.
14. Governing Law
These Terms and Conditions are governed by the laws of Spain, and any disputes arising from them shall be subject to the exclusive jurisdiction of the Spanish courts.
15. Amendments to Terms
Max Beach Golf reserves the right to update or amend these Terms at any time. Any changes will be communicated to guests at the time of booking or upon arrival. For any specific inquiries, additional or amended terms can be agreed via email directly with Max Beach Golf.
